1. How Do We Collect Information About You?

Kumon collects information about you in three main ways:

a. From the legal entities and local offices in the countries in which Kumon operates;
b. Directly from you. For example, direct interactions and user contributions; and
c. Indirectly from you, via the use of Cookies when you use Kumon Academy, see the Cookies section further within.

 

2. What Type of Information and Personal Information Do We Collect About You?

Kumon collects and processes information which includes personal information as part of Kumon Academy, the information we will collect and process is as categorised:

a. Account Information
i.  Name;
ii.  Address;
iii.  Email address; and
iv.  Phone number.
Account information is not viewable by other Kumon Academy users except for Kumon and Kumon staff.

b. Profile Information
i.  Profile name;
ii.  Profile image;
iii.  Text input by you (for example, a summary of yourself);
iv.  Websites you choose to provide links for; and
v.  Social media profiles you choose to provide links for.
Profile Information is viewable by other Kumon Academy users.

c. Shared Content
i.  Interactions and items shared as part of Kumon Academy and with other Kumon Academy users (for example, course reviews, submitted questions & answers, messages to other Kumon Academy users, information input by you including text, photos and other work you upload).

Shared Content may be viewable by other Kumon Academy users and is determined by the means it is submitted.

d. Course Data
i.  Courses you have enrolled on;
ii.  Course participation;
iii.  Course progress;
iv.  Interactions with other Kumon Academy users;
v.  Submitted assessments;
vi.  Submitted questions & answers;
vii.  Submitted items required as part of the course.

e. Communications and Support (as part of the support provision)
i.  Name;
ii.  Contact details;
iii.  IP address;
iv.  Support messages; and
v.  Other information submitted as part of the support provision.

Collected information is used to provide a response, including research into the basis of the support. A note in relation to the support is stored, processed and linked by user account.

f. Information Collected By Automated Means – We collect and process certain information by automated means, the information we will collect and process by automated means is as listed:
i.  System Data – Technical data about your computer or device, including IP address, associated general location, device information, browser type, operating system, manufacturer and your progression through the website including what areas you viewed and where you abandoned it.
ii.  Usage Data – Usage statistics about your interactions with Kumon Academy, including: content you access within Kumon Academy, time and date you spend on and access Kumon Academy including for each page, pages visited, features used.

Information collected by automated means is stored, processed and linked by user account.

 

3. Purpose And Legal Basis For Processing The Collected Personal Information

Kumon may use the collected information, which includes personal information, for the following purposes:

a. To provide Kumon Academy, communicate with you and administer user accounts and run our business:
i.  To provide the provision of Kumon Academy;
ii.  To administer the provision of Kumon Academy; 
iii.  To perform contractual obligations such as your participation on mandatory or voluntary training and courses;
iv.  To ensure the quality of Kumon Academy;
v.  To administer Kumon Academy user accounts;
vi.  To provide support to Kumon Academy users;
vii.  To seek feedback about Kumon Academy experiences;
viii.  To contact you with information about Kumon Academy and its development;
ix.  To respond to enquiries related to Kumon Academy and its materials; and
x.  To satisfy our legal obligations that we must comply with local or national government, authorities, agencies or courts and professional advisors.

b. To meet legal or regulatory requirements
We are required to comply with certain legal and regulatory requirements when providing Kumon Academy and we process personal information in order to comply with those requirements. On the occasion that we may be requested to provide certain information to regulators or law enforcement agencies and we will comply with these requests where legally required or permitted. This processing is necessary for compliance with a legal obligation to which we or the regulator or law enforcement agency are subject to.

c. To administer, maintain and improve our website and Kumon Academy
Kumon uses cookies for different purposes. Cookies are used for technical reasons, insights into user behaviour and to provide a personalised experience. See the Cookies section further within.

 

4. Who Kumon May Share Personal Information With

On occasion, we may provide Kumon Institute of Education Co., Ltd. (“KIE”), our parent company incorporated and based in Japan, with information about you for statistical and developmental purposes. Specifically, KIE may process your information for statistical purposes and to assist it in refining and further developing (i) Instructor training and (ii) the materials and instruction techniques. Kumon has adopted Binding Corporate Rules which provide a privacy compliance framework, so all Kumon companies are able to lawfully transfer personal data within the Kumon group in compliance with data protection legislation and regulations. International data transfers to KIE will be conducted in accordance with the Standard Contractual Clauses between Kumon and KIE. Furthermore, Japan is deemed to provide an adequate level of protection for personal data.

 

5. Kumon and Outsourcing?

On occasion Kumon will work with contractors to assist with efficiently and effectively administering and running the business and providing Kumon Academy. For IT needs including for the purposes of establishing, developing and maintaining relevant content and functions within Kumon Academy, as well as to enable effective communication with you.

6. How Long Do We Retain Your Information?

Kumon retains information about you for as long as it is necessary to fulfil the purpose for its collection and processing. Kumon has deemed the adequate length of time to retain information about you to be for the duration you are a licenced Kumon franchisee, and then a further three (3) years after you cease to be a licensed Kumon franchisee. Such rules apply unless we have legitimate reasons to otherwise do so; for instance, to retain it pursuant to any applicable legislation or regulation to which we are subject to.

7. Keeping Information About You Safe

Kumon has precautions in place to protect your personal information and have appropriate security measures against your personal information from being accidentally lost, used or accessed in an unauthorised way, altered, destroyed, damaged or disclosed. Access to personal information is limited to those Kumon employees and selected third parties who have a business need to know the personal information and will only be processed upon instruction from Kumon. Procedures have been implemented to handle any suspected breach. Furthermore, and where necessary, you and/or your data regulator will be notified of any potentially significant breach.

 

8. Cookies

A cookie is a small text file that is transferred to your computer or device when you visit a website or app, if consented to. Cookies are stored on your browser or hard drive and are unique to you. Cookies serve various purposes which can enable features, functionality and more. Kumon uses two main cookies for Kumon Academy.

9. Data Subject Rights

You have, in connection with your personal data, under certain circumstances, the right to:

• Request access to your personal information (known as a "data subject access request").
• Request correction of the personal information that Kumon holds about you.
• Request erasure of your personal information.
• Object to processing of your personal information.
• Request the restriction of processing of your personal information.
• Request the transfer of your personal information to another party.
• Withdraw consent at any time where you have provided your consent to the collection, processing, or transfer of your personal data, you may have the legal right to withdraw your consent under certain circumstances. To withdraw your consent, if applicable, please contact us in writing by using the contact information as listed in the Contact Information section.
  If you wish to exercise any of your rights (including exercising these rights on behalf of a child) or make a complaint, please contact us in writing by using the contact information as listed in the Contact Information section.
  You have the right to lodge a complaint with your supervisory authority/data regulatory body. You may exercise this right by contacting the supervisory authority/data regulatory body directly.

 

10. Changes to this Privacy Policy

This Privacy Policy is expected to change over time. We reserve the right to update it at any time, for any reason. We will notify you of changes to our Privacy Policy when it is necessary to do so.
If there are any differences between the English version of our Privacy Statement and a version translated in another language, the English version controls.
